        These Terms & Conditions govern your use of the swissCFO website and tools available at swisscfo.ch. By accessing or using our services, you agree to be bound by these terms.
    

1. Provider

The swissCFO platform and tools ("the Service") are operated by swissCFO ("we", "us", or "our"), based in Switzerland. For any questions, contact us at contact@swisscfo.ch.

2. Scope of Services

swissCFO provides web-based tools designed to assist Swiss businesses with financial administration tasks, including but not limited to:

Generating ISO 20022 PAIN.001 payment files from Swiss QR-bill invoices
Bank transaction file conversion and processing
Other financial workflow automation tools as published on the platform

The Service is intended for professional use by businesses, fiduciaries, and finance professionals operating in or with Switzerland.

3. Free Tier and Credits

Certain tools are available free of charge up to a defined usage limit (currently 10 free uses per tool, tracked via browser storage for anonymous users or via your account for registered users). Beyond the free tier, credits are required.

Credits can be purchased in packs via Stripe at the prices published on the platform.
Credits are non-refundable once consumed.
Unused credits do not expire unless your account is terminated.
Free uses are non-transferable and may be reset at our discretion.

4. User Accounts

Some features require you to create an account. You are responsible for:

Providing accurate and current registration information
Maintaining the confidentiality of your login credentials
All activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms or are used fraudulently.

5. Acceptable Use

You agree not to use the Service to:

Process fraudulent, falsified, or unlawful payment instructions
Attempt to reverse-engineer, scrape, or overload the platform
Circumvent usage limits or credit controls by technical means
Upload malicious files or content
Violate any applicable Swiss or international law

6. Data Processing and Privacy

Invoice processing in our tools is performed entirely client-side in your browser. Invoice files and the financial data they contain are not transmitted to or stored on swissCFO servers.

Account and usage data (email, credit balance, usage counts) are stored in our backend (Xano). Payments are processed by Stripe. For full details, see our Privacy Policy.

7. Intellectual Property

All content, software, and tools on swissCFO are the property of swissCFO or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent.

PAIN.001, CAMT.053, and related format specifications are standards published by SIX Group and ISO. swissCFO claims no ownership over these standards.

8. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. We do not warrant that:

The Service will be uninterrupted, error-free, or always available
Generated payment files will be accepted by any specific bank (you are responsible for verifying file compatibility with your bank)
The Service constitutes financial, legal, or accounting advice

You are solely responsible for reviewing all generated payment files before submitting them to your bank.

9. Limitation of Liability

To the maximum extent permitted by Swiss law, swissCFO shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to payment errors, bank rejections, or data loss.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid for credits in the 12 months preceding the claim.

10. Third-Party Services

The Service integrates with third-party providers including:

Xano — backend and database hosting
Stripe — payment processing
Netlify — website hosting

Use of these third-party services is subject to their respective terms and privacy policies. swissCFO is not responsible for the acts or omissions of these providers.

11. Changes to the Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will notify registered users of material changes to these terms by email. Continued use of the Service after changes constitute acceptance of the revised terms.

12. Governing Law and Jurisdiction

These Terms & Conditions are governed by Swiss law, excluding conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland.
